Imprisonment is considered the most common punishment for crimes committed in the most of the legislations of the countries in the world, due to the abolition of corporal punishment.

This research came to shed light on the concept of imprisonment in Islam, to identify the legality of imprisonment or imprisonment from the Qur'an and Sunnah, to the emergence of prisons in Islamic history, and whether there is a division of prisons and a mechanism for classifying prisoners, and the research presents the rights of prisoners and methods of dealing with them in the opinions of fiqh
