Abstract EN

ah law are represented in: achieving the interest of people in the present time and the future.

It is mainly to preserve five elements from any harms.

These are preserving of Faith, Life, Lineage, Intellect and Property.

As the new Corona virus pandemic occurred, rulings arose regarding it, especially in the matters of acts of worship.

Therefore, a disagreement arose among the jurists in this regard, which has created a contradiction between the principle of preserving the faith and the principle of preserving the life where all Divine laws agreed to preserve.

Thus, the majority of scholars gave preference to preserving faith over life, for which jihad, as an example, is prescribed where life might be lost in order to preserve the faith.

Yet, some scholars have argued that it is not permissible to suspend the acts worship in order to seek the preservation of life.

However, this research states that there is no conflict in the first place due to the existence of ranks of interests, so the embellishment interests (Taḥsīniyyāt) are below the complementary ones (ḥājiyyāt), and the complementary are below the essential ones (ḍarūiyyāt).

Consequently, it is evident through this paper that suspending congregational acts of worship in order to prevent further spread of infection and to reduce the causalities does not oppose the principle of preservation of faith.

Since the congregational acts of worship can be performed individually or in smaller groups at home.

Thus performing the acts of worship in a group is not necessary to preserve the faith, where the Shar'iah permits the Muslim not to perform the Friday prayer due to the existence of a legitimate excuse such as fear of danger to oneself or others.
