Abstract EN

This study is based on a major argument, that Ubuntu is a common philosophy among African societies and therefore African philosophy should be given the same standing as Western philosophy in treating transitional justice issues.

The argument that Africans had no philosophy in pre-colonial times is based on a false premise.

The study attempts to find how to apply the Ubuntu philosophy; To achieve transitional justice in African societies by the African People’s Courts, and that the constitutional courts of African countries as the highest judicial authority should promote the application of the Ubuntu spirit.

The study concludes that one of the main pillars of the implementation of transitional justice is reflected in the employment of social concepts and practices in Africa.

Where the sum of perceptions and concepts about the human role in building stable political and economic relations within his society.

A good example is what is called in traditional African culture "ubuntu", It is a cultural concept capable of building peace and resolving conflicts, as it allows in the local African culture the possibility of the aggressor asking for forgiveness from the victim, and in return the victim granting pardon to the aggressor.
