Abstract EN

This research deals with the purposeful diligence (ijtihad) of Caliph Omar Ibn Al-Khattab (may Allah be pleased with him) regarding the lands conquered by force.

The research is divided into two topics: the first topic explored the Jurisprudential Provisions on the Lands Owned by the State, where I addressed the ruling on lands owned by the State without fighting or using force.

The second topic dealt with Ijtihad by Omar (may Allah be pleased with him) and his views of Sharia objectives in relation to the lands conquered by force I have studied the rule of ijtihad on the conquest of land by force and the insightful objectives of ijtihad of Omar (may Allah be pleased with him) in this area.

In my research, I have adopted an inductive-deductive analytical approach based on evidence.

Accordingly, I sought to trace and investigate the details of this subject and link it to the general rules and fundamentals of jurisprudence, as well as the purposes of Islamic legislation.
