Abstract EN

Modern punitive thought tended to search forsolutionsto the crisis of the short-term imprisonment penalties, due to its many disadvantages.

Perhaps the most prominent solutions guided by contemporary punitive thought; isto create alternative punitive systems for penalties that deprive the freedom of liberty, while maintaining the short-term imprisonment penalties.

These systems are summarized in two main points: either in replacing deprivation of liberty partially, as the convicted person is imprisoned in special institutions partially, or replace the imprisonment.

One of these systems is the suspension of sentence that is adopted by the Jordanian legislator.

The legislator gave the judge discretionary powers to order the suspension of sentence, as well as restricting the suspension of sentence to felonies and misdemeanors, with the exclusion of the violations.

The social service is one of the alternative penalties stipulated by the Jordanian legislator within the amendment of the Penal Code No.

(27) for the year (2017), as the legislator linked the application of social reform alternatives to the suspension of sentence in accordance with the provisions of Article (54 bis) of the Penal Code.

Therefore, this study will address the suspension of the implementation of the punishment and the application of alternatives to societal reform, by studying Article (54 bis) and (25 bis) of the relevant Penal Code and trying to identify defects and address them in accordance with the penal code.
