Abstract EN

The implementation of the arbitration award in all disputes in general and administrative contract disputes in particular is of great importance, as it reflects the actual value of the arbitral award and bring it to existence.

In this research, it was found that Law No.

6 of 2018 gave the decision to adjudicate the dispute in arbitration a description of the “provision”.

It provides business sectors with dispute resolution mechanisms away from the courts, but the law did not give legal status to institutional arbitration in arbitration centers, with the exception of Decree No.

17 of 2019 adopting the statute of the Dubai International Arbitration Center.

Article 56 of the law stipulates that “filing an action against nullity of the arbitral award shall not result in the suspension of the execution of the judgment.

“The filing of a lawsuit invalidating the arbitral award shall not result in the suspension of its execution.” In addition, the research brought to light the competent authority responsible for issue an enforcement order in the arbitration ruling in the UAE law compared to French and Egyptian law.

The new law also answered in articles (2 and 3) the questions faced by the courts during the consideration of disputes relating to arbitration, and did not find a solution in the Code of Civil Procedure.

Among these questions, we cite the following: Which arbitration does this law apply to? When is the arbitration of an international character held even if it takes place within the countries? The researcher recommends that the legislator amend the situation in the arbitration law so that the judgment fulfills the conditions without suspension.

The legislator also clarifies the legality of institutional arbitration.
