Abstract EN

The subject of Gender identity, Gender and Sexual transference is still one of the subjects that are covered by secrecy and shame.

It is still one of the topics that most Arab legislations avoid, while it is a contemporary theme in foreign countries seeking to reach recognition of gender as a human right.

And because ignoring this does not mean that it does not exist, the winds of the West are blowing on our Arab societies, carrying with them ideas about the human right to choose their gender and convert their gender according to their gender identity, which foreshadows many problems in the near future if not faced.

This research deals with the subject of the legal change of gender, which is an update on the laws that regulate sexual transformation and its impact on criminal liability, especially in crimes that require a specific gender in the actor.

To elucidate this topic, we divided the research into two sections, the first of which dealt with the definition of gender identity and the position of the various legislations, the second dealt with transpersons, especially transgender and not transsexuals.

We ended with a conclusion in which we recorded the most important findings that we have reached and the recommendations that we believe we should address to the Federal legislature.
