English Abstract

Custody is considered the fertile field for judicial jurisprudence, given the problemssurroundingit.

The criterionadopted in Islamic fiqh and familylaw in assigning and abolishingcustodyis the interests of the childAmong the most important issues thatwere the subject of decisions from theSupreme Court was the issue of the custodial mother'sresidence in a country foreignto the country of the guardian of the child.

Through a careful extrapolation of thesedecisions, the stability of the jurisprudenceof the Supreme Court issued before 2008 on not assigning custody to the mother whoresides in a foreign country; due to the impossibility of exercising control andsupervision bey the guardian of the child, due to the distance, in application ofwhatisstipulated in Islamicfiqh.

However, the direction of the Supreme Courtchangedwith the issuance of a jurisprudence in 2008, whichruled out the issue ofguardianship and supervision, and assignedcustody to the mother in this case.

Perhaps the reason for thisis the assignment of guardianship to thecustodialmotherunder Article 3/87 of the Family Law amendedin 2005 by virtue ofOrdinance 02-05 to put an end to the problemsexperienced by custodialmothers, as stated in the deliberations of the National People'sAssembly, in the public sessionheld on March 2005, 14.
