English Abstract

The Family violence law was accompanied by several objections fromvarious Parties, and the United Nations has urged Iraq issued this law in Aprilof the year 2020 after the killing of an Iraqi woman named Malak Al-Zubaidi, who died of severe burns after she set herself on fire due to continuous familyviolence from her husband and his family.

There were conflicting opinions regarding this law, which was similar toone was issued in the Kurdistan Region in 2011, that also received differentopinions regarding it.

However, the legitimate view of this project was notsufficiently clear.

Among the things that promoted the issuance of this law, a statistic thatindicated that % 49 of Iraqi women are subjected to violence, which did notexplicitly state how this result was concluded.

On the other hand, the opposing side argues that the law does notcommensurate with the nature of the Iraqi Muslim society, because it is just ablind copy of the American Family Violence Law.

Taking into consideration that both parties have faulted the draft law, asthe supportive side sees it as below their ambition, while the opposing sideargues that the draft would eventually lead to the dismantling of the Iraqifamily structure, and to the abolition of the role of parents, as the childrenwould be exempt from family follow-up.

Accordingly, it was necessary to study this law in a neutral way, away fromhasty emotional reactions, both for and against.

This research included an introduction, and the following three chapters: The first chapter: the positive aspects of the draft law.

The second chapter: the negative aspects of the draft law.

The third chapter: the position of the Islamic Shari'ah on the draft law.

Then the conclusions, which included the most important results.

Andrecommendations.
