Creditors' guarantees in the debt declaration procedure The declaration of debt procedure is one of the most important procedural rules that creditors must meet its deadlines, and even considered as the most dangerous to their rights, whereas the neglect of pursuing the allocated deadlines for this procedure results in the loss of the creditors 'right to confront the debtor company on permanent basis.

Therefore the Moroccan legislator, and considering the seriousness of these effects, worked on creating a set of guarantees allowing these creditors to remedy the risks of missing the deadline for declaring debts on the rights of creditors, particularly with the recent modification of the content of the fifth book of the Commercial Code according to the law n°73.17.
