تتناول هذه الدراسة موضوع اختصاصات المحكمة الدستورية في الجزائر و المغرب، دراسة قانونية وفقا لمنهج مقارن يعالج إشكالية رئيسية تتمثل في: ما هي الاختصاصات التي تمارسها المحكمة الدستورية في الجزائر و المغرب و إلى أي حد تساهم هذه الاختصاصات في ترسيخ مكانة الدستور كأسمى قانون؟ من خلال التطرق إلى اختصاص المحكمة المتعلق بالرقابة الدستورية، و اختصاصاتها في المجال الانتخابي و الاستشاري، لتخلص هذه الدراسة في ختامها إلى عدة نتائج أهمها: أن وجود المحكمة الدستورية في الجزائر و المغرب و إناطة مهمة الرقابة على دستورية القوانين بها، يعد تطورا دستوريا مهما في البلدين، و لذا فإنه يلزم توفير الظروف و الإمكانات اللازمة لحسن سيرها في المغرب و ضرورة الإسراع بتنصيبها في الجزائر
Abstract EN
This study deals with the subject of the competences of the Constitutional Court in Algeria and Morocco, a legal study according to a comparative approach which addresses a major problem represented in: What are the competences exercised by the Constitutional Court in Algeria and Morocco, and to what extent do these powers contribute to consolidating the status of the Constitution as the supreme law? By addressing the jurisdiction of the court regarding constitutional control of electoral and consultative issues.
We conclude that, for its proper functioning, in Algeria and Morocco, the right tools must be urgently provided.
