Based on a comparative approach, this paper tries to analyze the concrete contours of online banking canvassing in Morocco in relation to personal data through the definition of legal mechanisms for the protection of such data against the risks weighing on their confidentiality at two levels, namely that relating to the collection and securing of personal data on the one hand, and that relating to the techniques of their deployment as well as the sanctions provided for in the event of violation of the law on the other.
The purpose of this paper is to draw the attention of the legislator on the insufficiencies and the gaps to be taken into consideration in the field of online banking prospecting in the project of recasting the law 09-08 relating to the protection of physical persons with regard to the processing of personal data in order to raise it to the level of the standards particularly the RGPD.

Partant d’une démarche comparatiste, cet article essaye d’analyser les contours concrets de la prospection bancaire en ligne au Maroc en relation avec les données personnelles à travers la définition des mécanismes légaux de protection de ces données contre les risques pesant sur leur confidentialité à deux niveaux notamment celui relatif à la collecte et à la sécurisation des données à caractère personnel d’une part, et celui portant sur les techniques de leur déploiement ainsi que les sanctions prévues en cas de violation de la loi d’autre part.
Le but de ce papier est d’attirer l’attention du législateur sur les insuffisances et les lacunes à prendre en considération en matière de prospection bancaire en ligne dans le projet de refonte de la loi 09-08 relative à la protection des personnes physiques à l’égard du traitement des données personnelles en vue de la hisser au niveau des standards particulièrement le RGPD.
