Abstract EN

In my research, I have followed the analytical approach in order to highlight the ineffectiveness of the constitutional reviews.

Therefore, I have tried to study and analyze the constitution’s articles that regulate the formation and functions of the Constitutional Council.

In my study, I have also relied on the comparative approach in order to be familiar with reformations adopted in other countries in relation to the constitutional reviews over the constitutionality of laws as in the case of France ( after the 2008 constitutional reforms) and Morocco ( after adopting the 2011 constitution).

This research discusses one of the obstructions that faces the reformation of the constitutional guarantees related to the protection of the individual rights and liberties in Mauritania; in this research, I will discuss the issue of the ineffective constitutional reviews in Mauritania.

This research will focus on the obstacles that hinder the constitutional reviews and the reasons behind the failure of the multiple amendments (especially the 2012 and 2017 amendments) to the 1991 constitution in promoting constitutional reviews.

Approach: I have attributed the ineffective constitutional reviews in Mauritania to many reasons related to the formation of the Constitutional Council (demonstrated in Section 1) and other reasons related to the limited powers of the Council (demonstrated in Section 2).
