Abstract EN

Arbitration has become a phenomenon of the modern era, and the resort to it has increased as a system for settling disputes because of the advantages it provides that are not achieved by the state’s judiciary, which is overburdened with cases, and also for the advantages it provides to contractors from different countries, as it avoids them the problem of not knowing the objective and procedural rules in foreign law.

Accordingly, we have studied the role of arbitration in settling trade contract disputes, an analytical and comparative study between national law and comparative laws in light of bilateral and multiple agreements to identify the nature of arbitration and its sources in resolving trade contract disputes and the principle of will in choosing the law applicable to a subject.
