Abstract EN

The Jordanian civil law quoting from the Islamic Jurisprudence divided the harmful act into direct and causing act and made the responsibility incurred without conditions with the direct and stipulated the transgression as a minimum withe the caused and by this it makes no harm in the direct action sufficient in itself to active responsibility without conditions.

This indicates that this division leads to dispensing with causal relationship as a pillar of responsibility but this issue has not been clearly evident in the Jordanian judiciary rulings, and therefore this research was conducted to show if it is possible to dispense with direct and causing the harmful act by a causal relationship.
