Abstract EN

The study tackled the nature of arbitration in electronic form seen as one of the most important means of resolving disputes arising from fast-concluded and executed electronic commerce transactions through the selection of arbitrator or arbitral tribunal that uses modern technological means to issue a binding judgment to the disputatious parties.

The researcher has used the descriptive and analytical approach, which is described in terms of a well-informed statement, the terms of issuance, and the analysis of the legal texts to indicate its legal basis in the arbitration law and the Electronic Transactions Law.

This study has arrived at several results, the most important of which is that the arbitration judgment carried out through modern devices and technology provides several advantages, such as speeding the settlement of disputes, reducing the costs and keeping abreast of the technological advancements.

Also, there are some problems facing this arbitration, the most important one is the lack of keeping up with the application of the legal rules concerning the traditional arbitration judgment.

The present research concludes with a number of recommendations to address the obstacles facing this type of arbitration.
