Arabic Abstract

إن الأطفال هم بهجة الدنيا وزينتها كما في قوله تعالى (المال والبنون زينة الحياة الدنيا) (1) وهم أمل الشعوب "لأنهم رجال الغد وعليهم تبنى الأمم نهضتها ، لذا فهم يحتاجون الى مزيد من الرعاية والحماية والاهتمام على كافة المستويات، إذ أن الطفل وفق التشريع العراقي كل من لم يكمل الثامنة عشر ، اذ لهم كافة الحقوق المدنية التي تتعلق بالحضانة والنسب والنفقة والرعاية والتربية والتعليم" ، ومن اجل حماية هذه الحقوق صدرت العديد من القوانين الداخلية وعقدت العديد من المعاهدات الدولية ، لضمان حقوق الطفل وضمان حياة كريمة لهم، وكان من نتيجة احتدام الحروب بين الدول إن تعرض الأطفال إلى الماسي والتدمير والتشرد وانحراف في سلوكياتهم، الأمر الذي نبه المجتمع الدولي إلى إنقاذ الطفولة من الآثار المدمرة، وبالنظر إلى أن الأطفال غير قادرين عل المطالبة بحماية أنفسهم وان العصر الراهن يقوم على الماديات في التعامل بين أبناء البشر ، فقد شهدت حالة الأطفال انتكاسة في حمايتهم ، بسبب كثرة الحروب بين الدول، مما جعل الأطفال أكثر عرضة للقتل والتشرد، ولأجل توفير حماية لهذه الشريحة الضعيفة وضحنا المقصود بالطفل والتركيز على أهم حقوقه ومظاهر الحماية المدنية للأطفال في التشريعات العراقية والمصرية ودورة الأسرة في حماية أطفالها وكيف يمكن معالجة التشرد بعد وقوعه.

English Abstract

Children are the joy and adornment of the world, as in the Almighty’s saying (money and children are the adornment of the life of the world), and they are the hope of the peoples because they are men of tomorrow and upon them the nations to adopt their renaissance, so they need more care, protection and attention at all levels, as the child according to Iraqi legislation is everyone who does not He completes the eighteenth, as they have all the civil rights related to custody, paternity, alimony, care, education and education, and in order to protect these rights many internal laws were issued and many international treaties were concluded, to guarantee the rights of the child and ensure a decent life for them, and it was as a result of the intensification of wars between countries that Children were exposed to tragedy, destruction, displacement, and deviation in their behavior, which prompted the international community to save childhood from the devastating effects, and given that children are unable to claim to protect themselves and that the current era is based on materialities in dealing with human beings, the situation of children has witnessed a setback To protect them, due to the frequent wars between countries, which made children more vulnerable to killing and displacement, and in order to provide protection for this vulnerable segment, we clarified what is meant by the child and focus on his most important rights.

Civil protection for children in the Iraqi and Egyptian legislations, the family’s role in protecting its children, and how homelessness can be dealt with after its occurrence.
