Arabic Abstract

تولد لدى المرأة على مر التاريخ الإحساس بحقوقها وضرورة المطالبة بها وهي من حقوق الأنسان التي لا تنفصل عنه وتمثل حمايتها حماية للمجتمع ككل وبالتالي يعد الاهتمام بالمرأة اهتماما" بالمجتمع والمحافظة عليها وحمايتها حماية لقيمه وأعرافه الاجتماعية، وقد اضطلعت المنظمات الدولية بدور مهم في رسم هذه الأسس التشريعية ووضع اليات الحماية اللازمة لها وقد أقرت معظم دساتير الدول هذه الحقوق وأرست قواعدها ومنها دستور جمهورية العراق لسنة 2005 ونص على الكثير من الحقوق للمرأة سواء كانت سياسية أو اجتماعية وثقافية ألا أن القوانين الوضعية قد تفاوتت في تفعيل هذه الحقوق عند التطبيق العملي ومدى ملائمتها للمواثيق الدولية لحقوق الأنسان عامة وحقوق المرأة بشكل خاص وتتجلى أهمية الدراسة في بحث اهم الحقوق التي تتمتع بها المرأة والحريات الأساسية لها وبيان اليات الحماية الدولية والوطنية لهذه الحقوق وسبل أو وسائل تحقيقها من خلال الأشراف والرقابة .أما مشكلة الدراسة فتتعلق بدراسة مدى التزام المشرع العراقي في مواءمة القواعد القانونية الوطنية ذات الصلة بحماية حقوق المرأة من حيث المضمون والأليات التي يتبعها القضاء الوطني في محاسبة الانتهاكات لتلك القواعد بالمواثيق الدولية التي التزم العراق بها من خلال التصديق عليها كما يتناول البحث اثر العوامل الاجتماعية والاقتصادية في التأثير على المشرع العراقي في تشريع القواعد القانونية الخاصة بحماية المرأة .

أما منهجية البحث فقد اتبعنا المنهج الوصفي التحليلي الذي يقوم على جمع واستقراء النصوص القانونية المتعلقة بحقوق المرأة في المواثيق الدولية والقوانين العراقية وأليات تحقيق الحماية القانونية لها ، وقد تم تقسيم الدراسة الى مبحثين نتكلم في المبحث الأول عن حقوق المرأة وخصائها في التشريع العراقي والقانون الدولي والذي يتفرع الى مطلبين نبحث في المطلب الأول ماهية حقوق المرأة وخصائصها وفي المطلب الثاني الحماية القانونية لحقوق المرأة بين التشريع العراقي والقانون الدولي أما المبحث الثاني فنتكلم فيه عن وسائل حماية حقوق المرأة بين التشريع العراقي والقانون الدولي والذي يتفرع الى مطلبين الأول الوسائل الوطنية لحماية حقوق المرأة والثاني الوسائل الدولية لحماية حقوق المرأة ومن ثم نخلص الى جملة من الاستنتاجات والمقترحات في خاتمة البحث.

English Abstract

Women have historically generated a sense of their rights and the need to claim them, which are inseparable human rights and represent the protection of society as a whole, and therefore women's interest in society, its preservation and protection is a protection of its values and social norms.

International organizations have played an important role in drawing up these legislative foundations and establishing the necessary protection mechanisms for them.

Most state constitutions have recognized and established their rules, including the Constitution of the Republic of Iraq, which provided for many rights women, whether political, social and cultural.

However, positive laws have varied in activating these rights in practice and their suitability for international conventions on human rights in general and women's rights in particular, and the importance of the study is reflected in the research of the most important rights enjoyed by women and their fundamental freedoms and the statement of international and national protection mechanisms for these rights and ways or means of achieving them through supervision and control The problem of the study relates to the study of the extent to which the Iraqi legislator is committed to harmonizing the national legal rules related to the protection of women's rights in terms of the content and mechanisms of the national judiciary in holding accountable violations of those rules by international conventions that Iraq has adhered to through ratification, as well as the impact of social and economic factors in influencing the Iraqi legislator in the legislation of legal rules on the protection of women.

In international conventions and Iraqi laws and mechanisms to achieve legal protection for them The study was divided into two researches that speak in the first research on women's rights and their characteristics in Iraqi legislation and international law, which is branched out into two demands that we discuss the first requirement what women's rights and characteristics are, and in the second requirement legal protection of women's rights between Iraqi legislation and international law, the second is about ways to protect women's rights between Iraqi legislation and international law, which is branched out into two demands: national means to protect women's rights, the second is international means to protect women's rights, and then we get rid of a number of Conclusions and proposals at the conclusion of the research.
