إن عنصر الماء بمختلف مظاهره، ظل حاضرا و فاعلا في البنية القانونية في تاريخ المغرب، و بالرغم من أن تنظيمه و تدبير قضاياه، إستند إلى منظومة قانونية متعددة المشارب، و الأهداف والوسائل في الفترة الوسيطة و المتتبع لمصادر موارد المياه في المغرب الأوسط يجدها محددة في التساقط، وجريان الانهار و الوديان، إضافة الى الآبار الخاصة، وقد نشأت نزاعات حادة حول الماء و تقسيمه و توزيعه.
و يعالج هذا الموضوع نظرة ساكنة بلاد المغرب الأوسط لثروة الماء؟ أو الماء بين الظرورة الاجتماعية و الاعراف السائدة، من خلال إظهار أساسيات صمود نظام السقي و انقياد الكثير من الناس له و مدى تناغم القانون المائي العرفي و ما يقره الشرع
Abstract EN
The element of water in all its manifestations has remained present and active in the legal structure in Morocco's history, and although its organization and management of its issues have been based on a multi-striped legal system, objectives and means in the intermediate period and the tracking of water resources in the Middle Maghreb, it finds it specific in the fall, Rivers and valleys, as well as private wells, have been run over, divided and distributed by rivers and valleys.
This topic addresses the inhabitants of the Middle Maghreb's view of the wealth of water? Or water between the social and prevailing norms, by demonstrating the basics of the resilience of the watering system and the oppression of many people to it and the extent of the harmony of customary water law and what is approved by the Shariah.

L'élément de l'eau dans toutes ses manifestations est resté présent et actif dans la structure juridique de l'histoire du Maroc, et bien que son organisation et sa gestion de ses questions aient été basées sur un système juridique, des objectifs et des moyens à plusieurs volets dans la période intermédiaire et le suivi des ressources en eau au Moyen Maghreb, il le trouve spécifique à l'automne, Les rivières et les vallées, ainsi que les puits privés, ont été envahis, divisés et distribués par les rivières et les vallées.
Ce sujet aborde la vision des habitants du Moyen Maghreb de la richesse de l'eau ? Ou de l'eau entre les normes sociales et dominantes, en démontrant les bases de la résilience du système d'arrosage et l'oppression de nombreuses personnes à elle et l'étendue de l'harmonie du droit coutumier de l'eau et ce qui est approuvé par la charia.
