Abstract EN

Marriage has a number of effects that are divided by the legislator in Article 12/1 of the Algerian Civil Code into personal and financial effects.

The first is represented in joint and separate marital rights and duties.

As for the second, is the rights and obligations of spouses with respect to their joint funds and how they manage them.

According to the above article, these effects are governed by the Law on the Nationality of the Husband at the time of the conclusion of the marriage contract, which is a distinct rule, a rule that is often difficult to implement and raises several problems that we will discuss in this study.
