تسلط هذه الدراسة الأضواء على الجوانب المعرفية و الإجرائية المتعلقة بمنهجية المنطق القضائي في سبيل تحسين جودة الأحكام القضائية من خلال إلقاء الضوء على جوهر المنطق القضائي و ما يرتبط به من مناهج استدلال قضائي تسعى جاهدة في استيعاب الواقع و القانون من أجل بناء حكم جزائي ذو جودة عالية الدقة و المتانة و الموضوعية.
و قد خلصت هذه الدراسة إلى نتائج من بينها غياب تام لعلم المنطق القضائي في مناهج تدريس الحقوق في كليات القانون المعاصرة وشح المؤتمرات الدولية في هذا المضمار ولعل من توصيات هذه الدراسة ضرورة إدراج علم المنطق القضائي ضمن مناهج تدريس الحقوق في كليات القانون و الاهتمام بفن صيانة الأحكام القضائية..
Abstract EN
This study explores the role of judicial logic and its impact on the quality and authenticity of criminal judgments, and demonstrates judicial logic approaches for the purposes of judicial reasoning within the framework of the logic of justice to build criminal judgments with high-precision quality.
Perhaps the most prominent recommendations of this study is the need to include the science of judicial logic in the curricula taught in law schools and institutions for preparing judges and lawyers, and to include a course on the way of drafting judicial rulings through the science of judicial logic.
