لقد تناول المشرع الجزائري الوقف و بين أحكامه في العديد من النصوص القانونية، من بينها القانون 84/11 المتضمن قانون الأسرة المعدل و المتمم بموجب الأمر 05/02 لاسيما في مواده من 213 إلى 220 ؛ و التي من خلالها بين الأسس العامة لهذه السنة الحميدة ذات الطابع التكافلي في أبعادها الاجتماعية و الاقتصادية.
لكن و بإجراء مقارنة بين ما تضمنته هذه المواد من أحكام و ما ينص عليه كل من القانون 91/10 المتعلق بالأوقاف و القانون 90/25 المتضمن التوجيه العقاري نجد تباين في بعض الأحكام مما يحتم إعادة صياغة بعض المواد المذكورة في قانون الأسرة الجزائري لتتماشى و الأهداف المنشودة من هذه العقود التبرعية
Abstract EN
The Algerian legislator addressed the moratorium and its provisions in several legal texts, including Law No.
84/11, which contains the amended family law, which is complementary under Order 05/02, particularly in its articles from 213 to 220, through which the general provisions are of a symbiotic nature in terms of the social and economic dimensions.
However, by comparing the provisions of these articles with the provisions of Law No.
91/10 on endowments and law 90/25, which includes the real estate directive, there is a discrepancy in some provisions, which necessitates the reformulation of some of the articles mentioned in the Algerian Family Law in line with the objectives of these donation contracts.
