Abstract EN

The Algerian legislator regulated the provisions for drawing borders for unburied contiguous properties, and the provisions of the common wall according to the provisions of Articles 703 to 708 of the Algerian civil code, where as for the demarcation of the borders, the Algerian legislator has leased to the neighbor the right to compel his neighbour to draw the border without his consent, provided the condition of contiguousness, a prescription the full, undisputed ownership, and that the determination expense be shared between them.

As for the dividing wall, the legislator has permitted the right to use it for the purpose for which it is intended, and the right to place beams on with the roof can rest, provided that no harm is caused to the neighbor and without carrying the wall beyond his capacity, provided that the owner alone bears the expenses of that.

But if the separation wall is not shared, the owner has the right to dispose of it, but he can only demolish it for a strong excuse in order to avoid harm to the neighbor who is hiding in it.
