It is noteworthy to mention that the establishment of the International Criminal Court is considered a turning point in the history of the international community.

Before such establishment, the leaders were not subject to any liability rules due to the unwillingness or inability of the national judiciary to exercise its jurisdiction in an independent manner.

The international tribunal was an idea that was brought in as a tool of the international community to ensure that no one evades liability.

Accordingly, the international tribunal is perceived to complement the national judiciary and does not act as a substitute to it to satisfy the aims of the humanity which are rule of law and equality and international responsibility as well as reducing the commission of these crimes on the international level.

In light of the foregoing, the complementarity principle has been massively developed on the international level, however the international community has to develop the complementarity principle to ensure the efficiency of the national judicial bodies and its capabilities in trying and litigating the perpetrators of such crimes.
