إن المشرع الجزائري قد حمى الأسرة في منشئها، حيث أسسها على مبدإ فطري كوني يقوم على أساسين اثنين، أساس التمايز الجنسي، و الأساس الشرعي، موضحا بذلك موقفه من الأنماط الأسرية الأخرى.
و عليه سنحاول في هذه الورقة البحثية بيان ما يتعلق بهذين الأساسين من أحكام، في القانون الجزائري و بعض القوانين المقارنة.
Abstract EN
The Algerian legislator protected the family at its origin, he founded it on an innate universal principle based on two bases, the basis of sexual differentiation and the legal basis, thus explaining his position on other family styles.
In this article, we will try to explain the provisions of these two bases, in Algerian law and some comparative laws.
