Abstract EN

It is difficult to understand the labor law and its contemporary transformations without going back to the historical origins of labor relations.

This would lead to look at the emergence of subordinated labor, and then the birth of individual labor relations, and understanding the nature of the conflicts between employers and workers in the 19th century, and how the labor class was able to reestablish the balance of labor relations in their favor thanks to the collective struggle, and then the emergence of collective labor relations.

It was a very hard and long journey: thanks to union and solidarity, workers were able not only to reestablish the balance with their employers, but also to incite the State to intervene in order to define rules that would protect the working class.

Furthermore, workers have created syndicates which considerably contributed to the elaboration of the rules constituting labor law.

Labor law is, in fact, a translation of the evolving nature of collective labor relations between employers and syndicates (workers’ unions), it is subject to the balance of power (conflict-cooperation) between the two parties, as well as to the will of the state to achieve social objectives
