Custom is considered a great document in the construction of legal rulings in countless chapters in Islamic jurisprudence of its various schools, and this research comes to highlight the position of custom as a legal guide in deriving legal and legal rulings and to indicate its authority and its considered conditions with dropping what has been obtained from theoretical data on the practical aspect related to custody disputes and the extent to which the judiciary takes into account this fertile, renewable and changing source with the change of time and place.
