Public transactions embodies the idea of the continuation of the public utility, and the most effective legal tool in protecting public money from corruption.

for this purpose, the Algerian legislator, by presidential decree 15-247 of September 16, 2015, amended the scope of application of public procurement procedures through articles 6 and 7 of it.

, using its original criterion, which is the organic criterion, while obligating the contracting authority in articles 41 and 42 to follow one of the two methods for concluding the public deal contract, either according to the solicitation method as a general rule for concluding, or through the consensual procedure as an exception to the general rule of contract this is what we will address in this study.
