The position of economic dominance represents a right and privilege that every institution seeks to reach, but if it is accompanied by the abuse of its exploitation, it constitutes a restrictive practice of competition in accordance with the provisions of Articles 07 and 14 of Ordinance 03-03 related to competition, as amended and supplemented.

And in view of the seriousness of the practice of abuse resulting from the situation of economic dominance over freedom of competition and market mechanisms, the Algerian legislator was keen to limit its negative effects by defining its forms and the conditions for its prohibition, as well as the penalties imposed on its perpetrators.
