There is no doubt that scientific progress in the field of genetic engineering and biotechnology has become a concrete reality, However, this progress and the accompanying scientific experiments, research methods and results are of great importance, which may lead to inevitable conflict with many legal principles.

Rather, the legal system must take into account this progress in the field of genes and propose various safeguards to reconcile it with established legal principles and the rights of individuals.

The use of genetic information in criminal investigations plays an important role in the detection of criminals, but their close contact with the individual's life, health and social status has raised the legal dilemma of the need to protect the right to protect genetic privacy with legislative guarantees in the field of criminal evidence.

In this intervention, we will address the protection of the right to genetic privacy in the field of criminal evidence, by addressing the various legislative guarantees established in the various comparative legislations, with a focus on safeguards established in Algerian legislation through Law 16-03 on the use of DNA in judicial proceedings.
