Doctors in private clinics are placed, of their own volition, in a contractual situation, this situation can take many forms, but the one we are interested in where doctors are bound to the clinic by a liberal practice contract.
This is most common in for profit institutions.
We their fore believe it is essential to undertake the analysis of the liberal practice contract, in order to enable us to highlight the reasons for the exclusive application of personal liability in private clinical doctors reports

Les médecins des cliniques privées sont placés, de leur propre volonté, dans une situation contractuelle.
Cette situation peut prendre plusieurs formes, mais celle qui nous intéresse où les médecins sont liés à la clinique par un contrat d'exercice libéral.
Cette situation est la plus fréquente dans les établissements à but lucratif.
Il nous semble donc indispensable d'entreprendre l'analyse du contrat d'exercice libéral, pour nous permettre de mettre en évidence les raisons qui justifient l'application exclusive de la responsabilité personnelle dans les rapports entre médecin et clinique privée.
