Abstract EN

The present research paper revolves around the Algerian constitutional founder who set the rule of distributing legislative competence between the legislative and executive authorities.

the former has authorised the government to initiate laws alongside members of parliament.

nonetheless, both the constitutional and legal organisation competences were not required by the principle of separation of powers, since it established the superiority of one authority at the expense of the other.

on the same line of thought, the enrichment of the original jurisdiction is restricted, and the way is opened to the government, which negatively affected the position of parliament.
