شهدت بلاد الأندلس خلال القرن الخامس الهجري وثبة فكرية تقدمها ثلة من العلماء و الفقهاء كان لهم مكسب في توجيه الحياة الفكرية الدينية و السياسية، خاصة مع ظهور المذهب الظاهري بزعامة ابن حزم و الذي يستند في استدلالاته على المبادئ العقلية المغايرة لأسس المذهب المالكي، فما كان على أقطاب الفكر الجدلي المالكي و على رأسهم الإمام أبو الوليد الباجي إلا التصدي لنهج الاتجاه العقلي الذي انتشرت أفكاره و عمت بلاد الأندلس بفضل كثرة أتباعه، فعمدت شخصية الإمام جاهدا للوقوف في وجه مثل هذه التيارات و الانتهاء بها و إقصائها من مختلف مجالات الحياة وفق أسس شرعية.
Abstract EN
During the fifth century ah, the country of Andalusia witnessed the emergence of Islamic scholars who had the utmost role in directing and guiding the intellectual religious and political life there, especially with the emergence of the Dahiri school of Ibn Hazm, which is based in his inference on rational principles different from the foundations of the Maliki school of thought, the personality of the imam strived to stand up to such currents and to end them and exclude them from various areas of life according to Islamic principles.
