The Algerian legislator sought to organize the construction and reconstruction process in line with the creation of an urban fabric that aims to preserve the urban public interest on the one hand and on the other hand protect public health and the environmental system in exchange for the embodiment of new fragmentation that paves the way for the establishment of major cities that devote the concept of new cities.

to achieve this goal, the Algerian legislator enabled the competent departments to extend their tribal control over the works to be completed under a set of licenses to ensure respect for building rules and urbanization plans.

and among these licenses is the retail license, which is considered one of the most important individual administrative decisions in the urban field, through which the competent administration verifies the ability of the land to be divided, and the extent to which building rights and easements are respected, especially those related to construction, as well as the extent of approval of the fragmentation process.
