Abstract EN

The crime of copying copyright is considered among the most serious crimes, as it affects one of the most important human rights, which is the copyright of the author over his intellectual production.

however, its effects become more dangerous in the digital environment.

the study aims to illustrate the concept of copyright imitation and its types, as well as its elements and penalties.

then to consider to what extent it can be applied to works in the digital environment.

this study, which relied on the analytical method, concluded that the Algerian legislator did not stipulate any provisions for the offense of copying copyright in the digital environment, but rather took the same penal provisions for the offense of counterfeiting contained in articles 151 to 160 of ordinance 03-05.

this makes them incompatible with the technical privacy of the digital environment and the private legal nature of digital works.
