this system constitutes a departure from the established general rules in the field of criminal trials, which made it a subject of debate and jurisprudential discussion, in terms of the extent of its respect for the rights and freedoms of the accused, and that by assessing the extent of his respect for the guarantees of litigation on the one hand and the rules governing fair criminal trials on the other hand.
