يعد موضوع الإشهار العقاري أحد أهم المناقشات حداثة وأهمية في القانون الإجرائي، لهذا السبب نناقش في هذا المقال دور الاجتهاد القضائي في تحديد وتوضيح الإجراء المتعلق بإشهار الدعوى في المحافظة العقارية.
وسوف نتناول أثر الاجتهاد القضائي في ضمان الأمن القانوني وحماية الحقوق العقارية من خلال هذه القاعدة الإجرائية.
Abstract EN
The land publicity of the lawsuit is one of the most significant current discussions in procedural law.
for this reason, we will examin in this article the role of case law to detrmine and explain the procedure of a publicity lawsuit in land conservation we will analyze the impact of the case law to ensure legal security and protect land rights.
