لقد اتبعت الجزائر في سبيل القضاء على أزمة السكن العديد من الأليات و المناهج تختلف باختلاف الدخل الفردي حيث وضعت صيغ سكنية تتوافق مع كل الطبقات الاجتماعية بهدف تحقيق العدالة الاجتماعية، حيث تم تخصيص السكن العمومي الإيجاري لذوي الدخل الضعيف، و صيغة السكن الترقوي المدعم و الإيجاري لذوي الدخل المتوسط، و تم تخصيص صيغة السكن الترقوي العمومي للفئة ذات الدخل المرتفع نسبيا، حيث من حقهم الحصول على سكن وفقا لصيغة التملك و قامت الدولة باستحداثه سنة 2014، لتضمه إلى الصيغ السكنية ذات الطابع الاجتماعي، باعتبار أن هذا النمط السكني مرحلة سابقة كان يخرج عن نطاق السكن الاجتماعي المدعم من طرف الدولة، نظرا لارتفاع أسعاره المرتبطة بارتفاع تكاليف إنجازه حيث كان يتكفل الصندوق الوطني للتوفير و الاحتياط بتمويله عن طريق موارده الخاصة بصفة مطلقة.
لذا تهدف الدراسة إلى توضيح هته الصيغة و شروطها و كيفية الحصول عليها و إجراءاتها القانونية و المستفيدين منها.
وصولا إلى أهم النتائج و المتمثلة في الثغرات القانونية المحاطة بهته الصيغة خاصة فيما تعلق بالمستفيدين منها.
Abstract EN
In order to eliminate the housing crisis, Algeria has followed many mechanisms and curricula that differ according to individual income, as housing formulas have been developed that correspond to all social classes with the aim of achieving social justice.
the public housing housing formula was allocated to the category with relatively high vinegar, as they have the right to obtain housing according to the ownership formula, and the state created it in 2014, due to its high prices associated with the high costs of its implementation, as the national fund for savings and reserves used to finance it, exclusively through its own resources.
therefore, the study aims to clarify this formula, its conditions, how to obtain it, its legal procedures, and its beneficiaries.
arriving at the most important results represented in the legal loopholes surrounded by this formula, especially with regard to its beneficiaries.
