Abstract EN

Throughout the ages, humanity has known the most heinous types of crimes, during which the international community knew various grave violations of humanity and human dignity, represented by the commission of war crimes, crimes against humanity, genocide and crimes of aggression recorded in history in various places and various times, which had a great and profound impact on the conscience of all mankind, which called on the countries of the world to search for mechanisms to avoid impunity for those who commit these crimes and thus achieve international criminal justice.

after difficult labors, it was reached to establish a permanent criminal court that works to prosecute perpetrators who commit serious crimes against human beings.

after nearly half a century, the international criminal court was established by Rome convention in 1998 where its statute entered into force in July of 2002, after long efforts made by the united nations and its members, considered as a historic step of all mankind in the field of international criminal law, where the authors of its statute worked to make it a consensual system satisfactory to all countries of the world, which helps in the effective functioning of this court.

however, the court’s path was not crowned with roses, as it encountered by a number of obstacles and problems that limited its effectiveness and impeded its work to achieving the goals and objectives for which it was established.

this is what we have tried to highlight and find solutions in this study.
