يعتبر نظام التعويض عن مسؤولية حارس الشيء في المادة 138 ق.
م بالغ الأهمية فهي مسؤولية دون خطأ و هذا خروجا عن القاعدة الواردة في المادة 124 ق.
م.
فمسؤولية حارس الشيء مسؤولية موضوعية تقوم على فعل ضار الضرر و العلاقة السببية إلا أننا نجد اختلافات في أساس قيام هذه المسؤولية في قرارات المحكمة العليا حيث نجد الخطأ المفترض و الخطأ الواجب الاثبات رغم أن ذلك غير ممكن فمسؤولية حارس الشيء تقوم دون حاجة لوجود خطأ و لا اثبات الخطأ.

Abstract EN
The system of compensation for the responsibility, of responsibility of the thing keeper in Article 138 C.C is extremely important.
The responsibility of the thing keeper is an objective one, based on a harmful act, the damage, and the causal relationship, but we find differences in the basis for establishing this responsibility in the decisions of the Supreme Court.
