تهدف هذه الورقة البحثية لتسليط الضوء على منصب محافظ الدولة في الجزائر فإذا كان استحداث هذا المنصب جاء بعد تنصيب مجلس الدولة و محكمة التنازع ثم المحاكم الإدارية فإن مختلف النصوص القانونية التي تمثل النظام القانوني له و واقع تطبيق هذه النصوص بالإضافة إلى تعدد وظائفه يشكل حدودا على أداء وظيفته الأساسية أي القضائية نتيجة عدم فهم المشرع لأهمية هذا الدور لمحافظ الدولة و اعتباره فقط ممثلا للنيابة العامة على مستوى هذه الجهات القضائية
Abstract EN
This paperaims to shed light on the post of governor of state in Algeria,if the creationthis post came after the inauguration of the Council of State and the Court of Cassation and the Administrative Courts in order to complementitsjudicial structure, the variouslegaltextsrepresenting the legal system of the Governor of the State and the application of these provisions, as well as the multiplicity of hisfunctions, constitutelimits to the performance of his basic function; In otherwords, the judiciary, especiallywith the continuous contradiction and lack of understanding by the legislature of the importance of thisrole for the governor of the state and consideringitonly as the representative of the public prosecutionat the level of thesejurisdictions.

Ce document vise à faire la lumière sur le poste de gouverneur d’Etat en Algérie, si la création de ce poste est intervenue après l’inauguration du Conseil d’Etat et de la Cour de cassation et des tribunaux administratifs afin de compléter sa structure judiciaire, les différents textes juridiques représentant l’ordre juridique du Gouverneur de l’État et l’application de ces dispositions, ainsi que la multiplicité de ses fonctions, constituent des limites à l’exercice de sa fonction de base; En d’autres termes, le pouvoir judiciaire, en particulier avec la contradiction continue et le manque de compréhension par le législateur de l’importance de ce rôle pour le gouverneur de l’État et de le considérer seulement comme le représentant du parquet au niveau de ces juridictions.
