After three preliminary studies, the international criminal court on March 3rd, 2021, the international criminal court was able to break a stalemate that lasted more than a decade on the situation of Palestine before the court.

from this point of view, the study aimedto provide a legal reading of the decision of the Pre-Trial chamber of the ICC on the request of the prosecutor to decide on the territorial jurisdiction of the court in Palestine under article 19 / 3 of the statute.

through analyzing the content of this decision and explaining the procedures that led to the opening of the investigation in this case, by analyzing the strategy that the Palestinian authority has used to refer to the international criminal court.

the study concluded that the confirmation of the decision is within the territorial jurisdiction of the court over the Palestinian territories occupied since 1967, it is considered a temporary success for the court, as the chamber only postponed the difficulties it faced to the next stages of the procedures.
