Arabic Abstract

تناولت هذه الدراسة علة إغاظة الكفار، وأثر هذه العلة في التطبيقات الفقهية، حيث قسمت الرسالة إلى خمسة فصول مقسمة إلى مباحث ومطالب وفروع، على النحو الآتي: فقد بينت الدراسة حقيقة القياس وأركانه ثم مفهوم العلة باعتبارها ركنا من أركان القياس وشروطها ومسالكها وأقسامها، ثم تحدثت عن مفهوم إغاظة الكفار وأدلة اعتبارها، مع بيان أقسامها ومجالاتها وضوابطها وذكر أمثلة من التطبيقات الفقهية القديمة والمعاصرة التي عللها الفقهاء بإغاظة الكفار، وخلصت الرسالة إلى أن إغاظة الكفار علة شرعية مؤثرة في عدد من الأحكام الفقهية ، بشروط منها: أن تكون موجهة للكفار المحاربين لا لأهل الذمة، وألا يترتب عليها مفسدة للمسلمين، كما أن إغاظة الكفار تدخل في جميع جوانب الحياة، وأن كل ما يحقق رفعة المسلمين وعزتهم مما يغيظ الكفار.

English Abstract

This study deals with the reasoning of the infidels' indignation, and the effect of that on jurisprudence applications.

Therefore, the thesis includes five chapters with suitable sections and topics as follows: The concept of analogy, its pillars, concept of reason, conditions, ways and divisions.

The study concentrates also on infidels' infatuation, its evidences of consideration, its sections, fields and controls, and citing examples of old and contemporary doctrinal applications that the jurists explained to infuriating infidels.

The thesis concluded that the infidelity of the infidels is a legitimate cause influencing a number of legislative rulings provided that it should be directed to the fighters (not to the dhimmis), and that it does not entail interest of Muslims.

Infidels' infatuation covers all aspects of life, which achieve the supremacy of Muslims and their pride, which infuriates infidels.
