Arabic Abstract

تناولت هذه الدراسة مبدأ المشروعية و ضمانات تحقيقه في القانون الأردني و التشريعات المقارنة، حيث تم في البداية إلقاء الضوء على ماهية مبدأ المشروعية و مصادره، سواء كانت مكتوبة أو غير مكتوبة، و الشروط المطلوبة لمبدأ المشروعية.

تطرقت في الفصل الأول إلى نطاق مبدأ المشروعية من خلال بيان السلطة التقديرية للإدارة و مبرراتها و مدى خضوعها للرقابة القضائية، و بين الفصل، كذلك السلطة المقيّدة مقارنة بالسلطة التقديرية، و مجالات التقدير حسب أركان القرار الإداري، كما تم التطرق إلى نظرية الظروف الاستثنائية بوصفه قيدا يرد على مبدأ المشروعية، من خلال بيان ماهيتها، و الشروط اللازمة لتطبيقها، و السند القانوني للأخذ بهذه النظرية حسب التشريع الأردني، من حيث خضوع هذه الإجراءات في الظروف الاستثنائية إلى الرقابة القضائية و بين هذا الفصل، أيضًا، نظرية أعمال السيادة بوصفه قيدا يرد على مبدأ المشروعية، و بيان ماهية هذه النظرية، و الأصل التاريخي لها، و المعايير التي تميز أعمال السيادة عن الأعمال الإدارية.

و تناول الفصل الثاني الضمانات الكفيلة باحترام مبدأ المشروعية، و دور مبدأ الفصل بين السلطات في تحقيق ذلك، و بيّن وسائل الرقابة غير القضائية، و هي وسيلة الرقابة الإدارية المتمثلة برقابة الإدارة نفسها على ما يصدر عنها من قرارات و ذلك ما يسمى بالرقابة الذاتية، أو الناتجة عن التظلم الإداري بنوعيه : التظلم الاختياري و التظلم الوجوبي، و الرقابة السياسية التي تمارسها السلطة التشريعية على أعمال السلطة التنفيذية و الرقابة القضائية، و أثرها على تطبيق مبدأ المشروعية، و كذلك حق الأشخاص في طلب التعويض عن تصرفات الإدارة من خلال دعوى التعويض.

English Abstract

This study addressed the principle of legitimacy and the guarantees of achieving it in the Jordanian law and the comparative legislations.

The study highlighted the meaning of legitimacy principle and its resources, either as written or not as well as the required conditions for the principle of legitimacy.

The first chapter addressed the range of legitimacy principle by demonstrating the discretion authority for the management, to be its justifications and the extent to which it is governed by the judicial surveillance.

The study also addressed the restricted authority in comparison with the discretion power and the domains of discretion according to the domains of managerial decision.

The study also dealt with the theory of exceptional conditions as a restriction related to the legitimacy principle by demonstrating their nature, and the terms for applying them and the legal context for adopting this theory in the Jordanian legislation and whether the intended procedures in the exceptional circumstances are subjected to the judicial surveillance.

The study also illustrated the theory of sovereignty activities as a restriction related to legitimacy principle, in terms of the nature of this theory, its historical origin and the standards that distinguish sovereignty activities from the managerial ones.

The second chapter addressed the guarantees for respecting the legitimacy principle and the role of the principle of separating authorities in achieving that.

The study demonstrated the non-judicial surveillance methods, referred to as the managerial surveillance represented by the management's control over its own decisions, self-control, or resulting from managerial complaint, with its two types; obligatory complaint and political surveillance that the legislative authority practice over the activities of judicial surveillance and executive authority and the impact of that on implementing the principle of legitimacy as well as the right to request compensation for the actions of the management through a compensation litigation.
