Arabic Abstract

هدفت الدراسة إلى التعرّف على موقف القانون الدولي الإنساني من الانتهاكات في الأعيان الثقافية في الأزمة السورية (2011 2108 دراسة في الاعتبارات السياسية، وقد تناولت الدراسة حجم الانتهاكات لقواعد القانون الدولي الإنساني، وما شكلته هذه الانتهاكات من جرائم إنسانية للشعب السوري، ومدى حجم التدمير الذي أحدثته الأطراف المتنازعة للأعيان الثقافية والمرافق العامة والبنية التحتية، وأبرزت الدراسة أن الاعتبارات السياسية قد سمت على الاعتبارات القانونية والإنسانية لغايات فرض الهيمنة والمكانة الدولية بالإضافة إلى لجوء الدول إلى الضرورة العسكرية لتبرير أعمالها الحربية.

اعتمدت الدراسة على توظيف المنهج التاريخي؛ لتتبع الأحداث التاريخية لتطور مسار القانون الدولي الإنساني والاتفاقيات الدولية التي تعزز تطبيقه، كذلك استخدمت الدراسة المنهج القانوني؛ لاستعراض أهم الاتفاقيات والبرتوكولات التي شكلت نواة تطور وترسيخ قواعد القانون الدولي الإنساني.

وقد توصلت الدراسة إلى مجموعة من النتائج والتوصيات، وبينت أن الاعتبارات السياسية تسمو على الاعتبارات القانونية في سلوكيات الدول المشاركة، كذلك أوصت الدراسة بضرورة تفعيل المؤسسات الدولية التي يلقى علي عاتقها تطبيق قواعد القانون الدولي الإنساني بشكل يسهم في تخفيض نسبة الانتهاكات الإنسانية في سوريا.

English Abstract

The study aimed to get acquainted with the position of international humanitarian law regarding violations in cultural affairs in the Syrian crisis (2011 - 2018).

A study on political considerations.

The study examined the extent of violations of the rules of international humanitarian law and the humanitarian crimes that these violations constituted for the Syrian people, and the extent of the destruction caused The conflicting parties to cultural objects, public utilities and infrastructure.

The study highlighted that political considerations have been named on legal and humanitarian considerations for the purposes of imposing hegemony and international standing, in addition to countries resorting to military necessity to justify their actions Warship.

The study relied on employing the historical approach to track the historical events of the development of the course of international humanitarian law and international agreements that enhance its application.

The study also used the legal method to review the most important agreements and protocols that formed the nucleus of the development and consolidation of the rules of international humanitarian law.

The study reached a set of results and recommendations.

The study showed that political considerations transcend legal considerations in the behavior of participating countries.

The study also recommended that it is necessary to activate the international institutions that are responsible for applying the rules of international humanitarian law in a manner that contributes to reducing the rate of humanitarian violations in Syria..
