Arabic Abstract

تناولت هذه الدراسة المسؤولية المدنية للكاتب العدل من حيث بيان مفهوم الكاتب العدل و واجباته المنوطة به و أهمية وظيفته و ماهية مسؤوليته المدنية، و عرضت للمبادئ العامة الواردة في القانون المدني الأردني عن المسؤولية المدنية بنوعيها العقدية و التقصيرية و جرى تطبيق أحكامهما على الكاتب العدل بغية الوصول إلى طبيعة مسؤوليته، و التي تبين أنها مسؤولية تقصيرية فيما يتعلق بالكاتب العدل العام و الكاتب العدل المرخص أيضا.

و خلصت الدراسة إلى أن مسؤولية الكاتب العدل تقوم على ثلاثة أركان و هي فعل الإضرار و الضرر و العلاقة السببية بينهما، فإذا تحققت هذه الأركان قامت مسؤوليته تجاه الشخص المضرور، و كان من حق الأخير مقاضاته وإلزامه بالتعويض عن الضرر، وكذلك فإن الدولة تكون مسؤولة عن أفعال الكاتب العدل الضارة كونه تابع لها.

و أوصت هذه الدراسة بسد النقص التشريعي المتعلق بعدم تحديد طبيعة مسؤولية الكاتب العدل و ذلك من خلال تعديل القانون المدني، و إدراج نص فيه يقضي بأن المسؤولية المدنية للموظف العام و من يقوم بعمل عام هي مسؤولية تتبع أحكام الفعل الضار الواردة في هذا القانون و كذلك إضافة نصوص إلى قانون الكاتب العدل تقضي بضرورة أن يكون الكاتب العدل المعين في هذه الوظيفة حسن السيرة و السلوك، بالإضافة إلى تعيين مساعد للكاتب العدل في عمله.

English Abstract

This study examined the civil responsibility of the notary in terms of clarifying the notary's concept, his duties, the importance of his job and what his civil responsibility is, and presented the general principles contained in the Jordanian civil law for civil liability in both contractual and default terms and their provisions were applied to the notary in order to reach the nature of his responsibility, which shows It is a tort liability for the notary public and the licensed notary as well.

The study concluded that the responsibility of the notary is based on three pillars, which is the act of harm and harm and the causal relationship between them.

If these pillars are realized, his responsibility towards the injured person is established, and the latter has the right to sue him and compel him to compensate for the damage, as well as the state is responsible for the harmful actions of the notary as he is dependent to her.

This study recommended filling the legislative deficiency related to not defining the nature of the notary’s responsibility by amending the civil law, and inserting a text in it stating that the civil responsibility of the public employee and whoever performs a public work is a responsibility that follows the provisions of the harmful act contained in this law, as well as adding texts to the writer’s law Justice requires that the notary appointed in this position be of good conduct and behavior, in addition to appointing an assistant to the notary in his work.
