Arabic Abstract

يُعدُّ نظام التحكيم من أهم وسائل تسوية المنازعات التجارية و الاستثمارية الداخلية و الدولية، و يمثل صورة من صور النظام القضائي الخاص، فوظيفته قضائي و قد كان الهدف الأساس من النظام التحكيم هو الفصل في النزاعات الناشئة عن العقود بأنواعها كافة، و لا بيد أن هذه الرسالة تتمحور حول عقود النفط، التي تُعد عقود استثمار أجنبية.

و لأن الدولة، دائما، طرف فيها، فقد عدها بعض الدارسين أقرب للعقود الإدارية.

و قد تناولت هذه الدراسة المرور الكثيف بشرط التحكيم والمسوّغات، والمميزات الإيجابية التي تدفع أطراف العقود لاختياره كوسيلة لفضّ أي نزاع ناشئ عن هذا العقد، فنجد أن عقود النفط تكاد لا تخلو من شرط التحكيم، الأمر الذي أدى إلى زيادة أهمية التحكيم في عقود النفط ؛ لما يتميز به من المزايا الكثيرة عند طرفي العقد، خاصة أن الطرف الثابت في مثل هذه العقود هو الدولة المستضيفة ما يسوغ أهمية تنظيم التحكيم، و جعله جزءًا من النظام القانوني للدولة البترولية.

لقد أصبح التحكيم ضمن أهم الوسائل لفض المنازعات في العقود النفطية، لذا ؛ فلا بد من تنظيم شرط التحكيم و صيانته الدقيقة.

و كذلك موضوع اختيار هيئة التحكيم و شروطها، فلا بد من التفرد بأهم القواعد التي يطبقها المحكمون، و مسألة القانون الواجب التطبيق، و التعرض لأهم الاتفاقيات الدولية التي نظمت التحكيم في عقود النفط.

English Abstract

Arbitration is considered to be one of the most important means for the settlement of local and international commercial and investment disputes.

It represents a form of private litigation as it has a judging function.

The primary goal of arbitration has been the settlement of disputes arising from all kinds of contracts.

Obviously, the core of this study is the contracts of oil which are considered as contracts of foreign investment that, due to the country being always a party in them, some has considered them to be closer to administrative contracts.

This study has dealt thoroughly with the arbitration clause and the justifications and positive features which lead parties of a contract to choose arbitration as a means to settle any dispute arising from this contract.

We find barely no oil contract that doesn't include and arbitration clause, the thing that led to the increasing importance of arbitration in these contracts because of its many benefits that it provides for both parties of the contract, especially with the hosting country being the fixed party in such contracts, which justifies the importance of regulating it and making it part of the legal system of an oil county.

Arbitration has become among the most important ways for the settlement of disputes in oil contracts in a way that it is necessary to regulate the arbitration clause and refine it side by side to the issue of choosing the arbitration panel and the rules which they are to abide to.

It is necessary to shed the light on the most important rules that arbitrators implement and on what law to apply and to deal with the most important international agreements regulating arbitration in oil contracts.
