Arabic Abstract

هدفت هذه الدراسة إلى التعرف على موضوع توزيع حصيلة البيع في المزاد العلني وفقا لقانون التنفيذ الأردني، و كيفية التوزيع و الأحكام العامة بهذا الصدد، و اجتهادات محاكم الاستئناف و محكمة التمييز بهذا الخصوص.

و لتحقيق أهداف الدراسة تم الاعتماد على المنهج الوصفي التحليلي لنصوص قانون التنفيذ الأردني و خرجت هذه الدراسة بنتيجة أهمها أن عملية توزيع حصيلة البيع هي آخر مراحل التنفيذ الجبري و أهمها و أوصت هذه الدراسة بعدد من التوصيات من أبرزها التفصيل اكثر بنصوص قانون التنفيذ المنظمة لعملية التوزيع من حيث المدد التي تحكم عملية التوزيع كإجراء تنظيمي.

English Abstract

This study aimed at identifying the issue of distributing the outcomes of execution in the Jordanian execution law, the methods of distribution and the provisions of that as well as the diligence of the court of appeal and the court of Cassation about that.

In order to achieve the study objectives, the researcher used the analytical descriptive approach for the articles of the Jordanian execution law.

The results showed that the process of distributing the outcomes of execution represents the last and most important stage of litigation.

In the light of the results, the study recommended giving more details about the articles of the execution law that regulate the distribution process as well as determining certain periods of time for the distribution process as an organizational procedure.
