Arabic Abstract

تسلط هذه الدراسة الضوء على موضوع التعويض عن الضرر الأدبي على نحر مقارن ما بين التشريع الأردني و التشريعات العالمية و الإقليمية من دول الجوار، ابتداء من ولادة فكرة التعويض عن الضرر الأدبي من رحم التشريعات البدائية إلى حين استقراره في التشريعات الحديثة، و تعريفاته القانونية بين سطور النصوص التشريعية الناظمة و التي عبرت عنه بمترادفات عدة جميعها كفلت ضمان ذلك الضرر بالمفهوم الذي تتحقق فيه خصائصه و تتوافر فيه شروطه القانونية و بصوره كافة البحثة و المقرونة بضرر مادي، ونقاط الخلاف و التباين التي ثارث بين التشريعات و الشراح حول التعويض عن الضرر الأدبي في ظل المسؤولية المدنية في مدى تصور الضرر الأدبي في المسؤولية العقدية و بالتالي تعويضه، و الخلاف في تحديد طبيعة التعويض عن الضرر الأدبي، أهي عقوبة توقع على مسبب الضرر أم تعويض حقيقي للمضرور، و كيف وصل الأمر إلى اعتبارها ترضية، بأن مصطلح التعويض بهذا الصدد يعنى به تخفيف المواساة و ليس التعويض بحرفية الكلمة .

كما وعالجت هذه الدراسة استحقاق التعويض عن الضرر الأدبي باعتباره ضررا أصليا و أحيانا ضررا منعكسا على طائفة معينة تحيط بالمضرور، و إجراءات المطالبة بالتعويض عن الضرر الأدبي أمام القضائيين المدني والجزائي، و الأمس التي قد يستند إليها القاضي في تقديره لمبلغ التعويض عن الضرر الأدبي في ظل غياب منهجية واحدة و معيار تشريعي واحد يرجع إليه القضاء عند تقديره التعويض عن الضرر الأدبي.

English Abstract

This study highlights the issue of compensation for moral damage in a comparable between Jordanian legislation and international and regional legislation from neighboring countries, starting from the birth of the idea of compensation for moral damage from the womb of the primitive legislation until stability in modern legislation, and definitions of legal between the lines of legislative provisions governing Which expresses it in several synonyms, all of which have ensured that this harm is damaged by the concept in which its characteristics are realized and its conditions are fulfilled.

For legal, and in all, pure and material damage combined for moral harm and for the moral harm to the judge, The points of disagreement and differences that have arisen between the legislation and commentators on compensation for moral damage under the civil liability in the extent of perception of moral damage in the contractual responsibility and thus compensate, and the dispute in determining the nature of compensation for moral damage, whether it is punishment to sign the cause of damage or real compensation to the injured person, and how they arrived The matter is considered conscientious, that the term compensation in this respect means the relief of sympathy and not compensation in the literal of the word.

This also addressed the study of compensation entitlement for moral damage as damage to original and sometimes reflected damage to a certain range surround The harmed , and claim compensation for moral damage to the judicial proceedings, civil and criminal, and foundations that may be based on the judge in his assessment of the amount of compensation for moral damage in the absence of One methodology and one legislative standard to which the judiciary refers to when assessing compensation for moral damage.
