وضحت هذه الورقة البحثية النظام القانوني المسير للجماعات المحلية المتمثلة في البلدية و الولاية و ذلك في إطار تقريب الإدارة من المواطن و تحقيق التنمية المحلية بمنح صلاحيات و استقلالية تامة لهذه الوحدات في إطار لامركزية الإدارة، غير أن ذلك يصطدم بوجود رقابة فوقية من السلطات الوصية قد تحد من أداء و عمل السلطات المحلية في تحقيق أهدافها و كيفية إدارة هذه الاستقلالية المنصوص عليها قانونا في تنظيم عملها، و هو ما يتطلب إيجاد توافق بين هذه الرقابة الفوقية و الصلاحيات الممنوحة للجماعات المحلية لتحقيق الهدف المنشود، و هو إيجاد مجالس منتخبة قوية محققة للتنمية المحلية
Abstract EN
This research paper illustrated the legal regime of local communities in terms of the municipality and the mandate, in the context of bringing the administration closer to the citizen and local development by granting full powers and autonomy to these units in the context of decentralized administration, However, it is also the case that there is a meta-control of the regency that may limit the performance and functioning of the local authorities in achieving their objectives.
